Our Terms of Use are a legal agreement between you and letsps LLC. IN ADDITION, IF THIS TERMS OF SERVICE IS BEING AGREED TO BY A COMPANY OR OTHER LEGAL ENTITY, THEN THE PERSON AGREEING TO THIS TERMS OF SERVICE ON BEHALF OF THAT COMPANY OR ENTITY HEREBY REPRESENTS AND WARRANTS THAT HE OR SHE IS AUTHORIZED AND LAWFULLY ABLE TO BIND THAT COMPANY OR ENTITY TO THIS TERMS OF SERVICE ON BEHALF OF SUCH ENTITY. GENERAL TERMS By creating an Account in letsps as an authorized User and/or by accessing and using the letsps website, and you acknowledge that you, on your own behalf as an individual and on behalf of your employer or another legal entity (collectively, “you” or “your”), have read and understood and agree to comply with these Terms, and are entering into a binding legal agreement with letsps LLC. and/or, where applicable, one of its group companies or affiliates (“letsps”, “us”, “we” or “our”). If you are creating an Account, you are entering into these Terms on behalf of your team, company, organization or any other entity that you either represent or belong to (the “Organization”), and you represent and warrant that you have or you were granted full authority to bind your Organization to these Terms. If you do not agree to comply with and be bound by these Terms or do not have authority to bind your Organization, please do not accept these Terms or access or use the Platform. To the extent allowed under applicable law, you hereby waive any applicable rights to require an original (non-electronic) signature or delivery or retention of non-electronic records. If you have executed a written contract, service order or other agreement with letsps governing your access to and use of our site, then the terms of such agreement will govern and will supersede these Terms; except for the terms herein that refer to your access to, use of and/or registration for the Site, all which shall remain in effect. All capitalized terms used herein shall have the meanings given for such terms herein. YOUR USE OF SERVICES Your consent to be bound by these terms is both on your own behalf and on behalf of any corporate entity that employs you or which you represent, and the term “you” as used herein will be deemed to refer to both you and your employer, jointly and severally. You represent and warrant to us that you are of the age of majority in your jurisdiction; and have acquired the consent of legal or parental guidance to agree on the Agreement on your behalf (in case of a minor). Contact us with details of the URL which you wish to link to this website and the URL of the page on which you will be displaying the link. We do not permit the display of any web pages which form part of this website in any html frame unless we have expressly authorized in writing. COPYRIGHT For the purposes of these terms and conditions the expression “Website Information” means the images, graphics, text, applets and scripts operating, operating in, or which form part of, this website. All intellectual property rights in the Website Information are owned solely by letsps. You may view Website Information in a web browser for private browsing purposes only. INDEMNIFICATION By entering into this Agreement and using the Application or Service, you agree that you shall defend, indemnify and hold the Company, its licensors and each such party’s parent organizations, subsidiaries, affiliates, officers, directors, Users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) arising out of or in connection with: (a) your violation or breach of any term of this Agreement or any applicable law or regulation, whether or not referred to in this Agreement; (b) your violation of any rights of any third party, including any providers of transportation services, (c) your use or misuse of the Application or Service. VETENARY DISCLAIMER No matter the qualifications of the person answering your question, by using the letsps Service you expressly acknowledge that the letsps Service is NOT a substitute for veterinary care (whether emergency or otherwise), and you further acknowledge that neither we nor our Pet Experts can provide advice or consultation over the internet regarding any specific medical condition (whether of an emergency nature, or otherwise) without a thorough and proper physical evaluation of the pet. In addition, the quality of the responses provided by the Pet Experts will be influenced directly by the quality of the question asked (and the completeness and accuracy of the information conveyed by the person asking the question), of which neither we nor the Pet Experts have any control. If your pet is sick, injured, or otherwise in need of medical attention, you agree to contact your regular veterinarian or local emergency provider of veterinary services immediately. You also expressly acknowledge and agree that in the case where one of the Pet Experts who is a licensed veterinarian answers your question(s), a veterinarian-client patient relationship will NOT be established, and that the letsps Service will NOT be able to diagnose, treat, or prescribe any medication for your pet. You further acknowledge that the laws, regulations, other governing authorities, standards, practices and procedures that apply to your particular question may differ depending upon your location or upon the information that typically would be discovered through in-person (or in-pet) evaluations or visits. By using our Service, you understand that any licensed veterinarian that answers your question(s) is NOT your pet’s veterinarian, and that the information they provide to you is NOT a substitute for in-person veterinary diagnosis and/or treatment. Please be advised that nothing transmitted to or via our Service constitutes the establishment of a veterinarian-patient relationship between you (or your pet) and any professional. We highly recommend that you always seek the advice of your veterinarian or other qualified provider with any questions that you may have regarding your pet’s medical condition, and that you do not disregard their advice (or delay seeking their advice) because of something that you have read or otherwise been provided via our Service. DISCLAIMER OF WARRANTY BY VISITING OUR WEBSITE AND USING OUR SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THERE ARE RISKS AND LIMITATIONS ASSOCIATED WITH ONLINE SERVICES SUCH AS THE LETSPS SERVICE, AND THAT YOUR RELIANCE ON ANY CONTENT, RECOMMENDATION OR OTHER ADVICE CONTAINED ON OUR SITE IS SOLELY AND EXCLUSIVELY AT YOUR OWN RISK.
